Martin Dispute Resolution

About

Linda is an approachable, impartial, perceptive mediator who excels at settling cases.

She has practiced law for over 40 years and earned a reputation as a tenacious and successful advocate and litigator for her clients. Linda brings that same dedication to her mediation practice and loves the satisfaction of resolving cases. An eternal optimist at heart, Linda views dispute obstacles as opportunities and embraces the challenge.

Linda is “AV” rated by Martindale Hubbell – which issues the rating only to those attorneys who have demonstrated preeminent legal abilities and the highest professional and ethical standards. She has represented both plaintiffs and defendants in personal injury, civil rights and medical malpractice cases at a busy boutique law firm where she was the Managing Partner. Empathetic, respectful and fair, she connects well with attorneys and parties alike so their positions can be heard and they can vent – giving her the opportunity to understand the nuances of the case while providing a supportive process that allows for effective, productive and expeditious resolution of cases.

An experienced trial lawyer, Linda has volunteered her time as a settlement officer for the Orange County, Riverside County and San Bernardino County Superior Courts. She was chosen and serves as a member of the U. S. District Court Central District Mediation Panel. As an attorney and mediator, she has been involved in more than 500 mediations and arbitrations.

Testimonials

Linda Martin is a Mediator who has the background and experience to go straight to the key issues in a case. She is uniquely suited to resolving complex cases involving death and catastrophic injuries. She is no-nonsense, straight ahead and combines a down-to-earth sensibility with her actual trial experience. She prepares in advance and it is apparent that she has an informed strategy and approach to moving a Mediation towards resolution. Her Mediations move quickly. She does not waste time. Because of her experience she sometimes sees important issues in a case that others did not think about. Her language with lawyers and clients is not “attorney speak” or “legalese” although she is smart, up-to-date on the law and can dive right in and compare and contrast the probable real-world trial outcome of the two-sides’ positions. Almost all of the cases in which we have used her have resolved, with many of them being the type of case that both sides are entrenched, far apart on valuation and appear will not settle. Our Civil Rights Law Firm exclusively represents Plaintiffs against law enforcement Defendants in death and very serious disabling injury cases. These cases are complex and involve many “inside baseball” types of issues like cause of death or permanent neurological injuries, future medical care and life-care plan, toxicology, reconstruction and police practices. These cases also involve allegations of complete or partial defenses and Motions for Summary Judgement/Adjudication based on doctrines like Qualified Immunity and multiple layers of potential Motions in Limine, bifurcation and which types of evidence will most likely be admitted at trial. We knew of Linda Martin as a very skilled attorney at her firm Rinos & Martin, LLP who has represented law enforcement Defendants in the same kinds of cases we file against law enforcement. Admittedly, when Linda Martin was first mentioned as a Mediator we were somewhat reluctant to use her. However, we found that the reality is, whichever side you are on, Linda Martin is the type of Mediator you want to have. She has the real-world skill and experience, has been in the room with decision makers and knows how to move the parties to resolution.
